These terms and conditions form the basis for the use of this platform, which we have created for our customers and partners and which we operate and develop carefully. If you do not agree with all or parts of these terms and conditions, please do not use our services. Of course, you can also contact us (see section H).
All of this information is important as it (together with your booking confirmation and any pre-contractual information provided to you prior to booking) sets out the legal terms on which our booking partners offer their car parks and services through our platform.
If something is wrong with your booking, we explain what you can do about it in section H of these GTC. This includes lodging a complaint with us, communicating directly with the licence partner concerned and going to court.
A. Understanding the Happy Trucker GmbH
The company has set itself the task of focusing on the interests of truck drivers (also referred to here as truckers) on their tours along the trunk roads, improving their working conditions and at the same time helping their employers to save costs.
B. Our platform
- We receive information from licence partners and cannot guarantee that everything is correct. But in providing our platform, we take reasonable care and act with professional diligence. Unless we have failed to do so or acted negligently, we cannot be held responsible for errors, interruptions or missing information attributable to our licence partners. Of course, we will do everything we can to rectify problems as soon as we become aware of them.
- Our platform does not favour any of the licence partners. You decide for yourself whose service you want to use.
- We are not a party to the terms and conditions between you and the respective licence partner. The licence partner is solely responsible for the structure of its prices, cancellation conditions and other terms and conditions. By completing the booking, you accept the terms and conditions of our licence partner. These can be accessed at any time via our support team and the licence partner's website.
- You only conclude a contract with Happy Trucker for the successful referral to the offers of our licence partners. They alone work directly with the respective parking area operators.
- To make a booking, you should create a customer account. Please ensure that all your details (including payment and contact information) are correct and up to date, otherwise the pitch booking may not be able to be completed. You are responsible for everything that happens with your account. Therefore, do not allow anyone else to use it and keep your user name and password secret.
- Unless otherwise stated, you must be at least 18 years old to use this platform.
C. Prices, payment, cancellation
- The prices are displayed transparently before each booking and for each area
- Payment is made immediately upon completion of the booking using the credit card provided. Other payment methods are in preparation and will be made available at a later date. Payment on account is not offered. However, you will receive a receipt with your booking.
- If you have a company account, you have the option of receiving monthly statements of the transactions made via your company. Each driver also has an overview of their bookings in their driver account.
- Payments are always made in euros (€). If the account to be debited is not in the euro currency area, the exchange rate specified by your payment service provider at the time of the debit will apply. Happy Trucker has no influence on the exchange rate.
- If you cancel a booking within the permitted cancellation period, only the cancellation fee in euros stated in the corresponding booking confirmation will be due. Happy Trucker accepts no liability for any losses due to changes in exchange rates. The cancellation deadline can be found in the booking details. If nothing is stated there, you can cancel the booking up to 30 minutes before the start of the booking period.
- We store the information about your payment method for future transactions, after we have obtained your consent .
D. Guidelines
- When you make a booking, you accept the applicable policies displayed during the booking process. The cancellation policy and any other policies of the licence partner (on access restrictions, security/damage deposits, insurance, behaviour on the sites, etc.) can be found on the information pages of the licence partners, during the booking process, on signs in the parking areas, etc.
- If you cancel a booking or fail to arrive, any cancellation/no-show charge and any refund will be subject to the Licence Partner's cancellation/no-show policy.
- If you think you will not arrive on time, we recommend that you cancel your booking and make a new one.
- As the person making the booking, you are responsible for the actions and behaviour (in relation to the parking process) of any person associated with the vehicle in question. You are also responsible for obtaining their permission before providing us with their personal data.

F. Insurance
Some of our licence partners offer insurance for each individual parking process, which can or must be taken out as part of the booking. If part of the total price includes insurance, you will find detailed insurance information on the website of our licence partner.
G. Intellectual property rights
- Unless otherwise stated, all rights to our platform (technology, content, trademarks, look and feel, etc.) belong to Happy Trucker GmbH. By using our platform, you agree to use it solely for its intended purpose and in accordance with the terms and conditions set out below.
- You may not monitor, copy, extract, download, reproduce or otherwise use anything on our Platform for any commercial purpose without the written permission of Happy Trucker GmbH or its licencees.
- We pay close attention to every visit to our platform and block anyone (and any automated
system) that we suspect of the following:
- perform an unreasonable number of searches,
- use a device or software to collect prices or other information,
- to do something that places an undue burden on our platform.
- For the avoidance of doubt, we are neither responsible nor liable for any images uploaded or submitted to our platform. We may remove any image at our sole discretion (for example, if we find that the image does not meet the above criteria).
H. Support/Contact/Complaints
- If you have a question or complaint, please contact our customer service team.
You can help us respond as quickly as possible by providing us with the following:
- Your booking number, your contact information, Happy Trucker customer number (if you have one) and the email address you used for your registration,
- a summary of the problem, including how you would like us to help you,
- all related documents (account statement, pictures, receipts, etc.).
- All questions and complaints are recorded and the most urgent are given top priority.
- We endeavour to resolve disputes internally and we are not obliged to submit to alternative dispute resolution processes conducted by independent providers.
- Of course, you can also take legal action at any time.
- Should you have any problems with access to the parking area or other problems during the parking process, you can call the hotline numbers of our licence partners. Happy Trucker itself has no contact with the car parks.
I. Measures against inappropriate behaviour
- If you violate these terms and conditions, including our values and policies, or fail to comply with applicable laws or regulations, we have the right to suspend or terminate your access.
- If we cancel a booking, you may (depending on the circumstances) not be entitled to a refund. Where appropriate, we will tell you the reason for such cancellation unless such notification would (a) contravene applicable laws and/or (b) prevent the detection or prevention of fraudulent or other illegal activity. If you believe that we have cancelled your booking in error, please contact our customer service team.
J. Limitation of liability
- Any claims for damages against Happy Trucker GmbH are excluded. This does not apply
- for claims for damages arising from grossly negligent or intentional injury to life, limb or health,
- in the case of a guarantee or contractual agreement regarding the properties, or
- for claims for damages for a breach of material contractual obligations (cardinal obligations) and
- for further claims for damages for intentional or grossly negligent breach of duty by Happy Trucker GmbH, its legal representatives or deputy authorised representatives.
Material contractual obligations are those whose fulfilment is necessary to fulfil the purpose of the contract. In the event of a breach of material contractual obligations, Happy Trucker shall only be liable for compensation in the amount of the agency fee already paid.
- We do not make any promises about the products and services of licence partners or service providers (unless we explicitly state this in these terms and conditions). It is entirely your responsibility to make the right choice.
K. Applicable law and place of jurisdiction
- These terms and conditions are governed by German law. You may also rely on your national consumer law if you are a consumer living in a country of the European Economic Area, the United Kingdom or Switzerland ("Europe").
- The exclusive place of jurisdiction is Leipzig (Germany).
L. Amendment clause
- We may make changes to these Terms and Conditions. If such changes are material, we will notify you before the changes take effect, unless the changes are required by applicable law.
- If you do not agree with the changes, please do not use our platform.
- Otherwise, your continued use of our Platform after the effective date of the proposed changes will constitute your acceptance of the revised Terms and Conditions.
- For existing bookings, the terms and conditions valid at the time of booking continue to apply.
M. Other
- By finalising your booking, you accept these terms and conditions and any other terms and conditions made available to you during the booking process.
- Should an authority decide that some of these terms and conditions are unlawful, the remaining terms and conditions shall continue to apply.
N. Our values
Happy Trucker sees itself as a professional intermediary between logistics companies and their drivers and the providers of parking spaces for lorries and other commercial vehicles.
We make sure that our licence partners only include areas in their portfolio and offer them via Happy Trucker that meet certain quality standards.
Happy Trucker attaches particular importance to compliance with the GDPR, the free democratic basic order (FDGO), respect among people - especially towards truck drivers - and the dignity of people. Happy Trucker is against marginalisation and racism.
